By inviting or using KillSync ("the Bot") in your Discord server, you explicitly agree to comply with and be bound by these Terms of Service. If you do not agree with any part of these terms, you are prohibited from using the Bot.
KillSync is designed as a community companion bot for EVE Online. Its primary functions include:
We collect only minimal data necessary for the Bot's operation, as detailed in our Privacy Policy. By using the Bot, you acknowledge and agree to our data handling practices. It is your responsibility to inform your Discord server members about the Bot's presence and any automated actions it performs, particularly regarding data collection as outlined in the Privacy Policy.
KillSync is provided "as is" and "as available." We reserve the right to modify, suspend, or discontinue the Bot, or any part of its functionality, at any time without prior notice or liability. While we strive for high uptime and reliability, we cannot guarantee uninterrupted or error-free access to the Bot.
You agree not to use KillSync for any purpose that is unlawful or prohibited by these Terms. Prohibited activities include, but are not limited to:
We reserve the right to ban the Bot from any Discord server or revoke individual user access at our sole discretion, without prior notice, if we determine that these Terms of Service have been violated or if the Bot's integrity or performance is at risk.
KillSync is provided without any warranties, express or implied. We disclaim all warranties, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall KillSync or its owner be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Bot; (ii) any conduct or content of any third party on the Bot; (iii) any content obtained from the Bot; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
These Terms shall be governed and construed in accordance with the laws of Sugar Hill, Georgia, United States, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Bot after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Bot.
